Memorandum sulle garanzie di sicurezza in connessione con l'adesione dell'Ucraina al Trattato di non proliferazione delle armi nucleari

       про гарантії безпеки у зв'язку з приєднанням України

          до Договору про нерозповсюдження ядерної зброї

     Україна, Російська  Федерація,  Сполучене Королівство Великої

Британії та Північної Ірландії і Сполучені Штати Америки,

     вітаючи приєднання  України  до Договору про нерозповсюдження

ядерної зброї ( 995_098  )  як  держави,  що  не  володіє  ядерною

зброєю,

     беручи до уваги зобов'язання України ліквідувати  всю  ядерну

зброю, що знаходиться на її території, у визначений період часу,

     відзначаючи зміни ситуації в галузі безпеки в усьому світі,

     включаючи  закінчення  холодної  війни, що створили умови для

глибоких скорочень ядерних сил,

     підтверджують таке:

     1. Російська   Федерація,   Сполучене   Королівство   Великої

Британії   та   Північної   Ірландії  і  Сполучені  Штати  Америки

підтверджують  Україні  їх  зобов'язання   згідно   з   принципами

Заключного акта  НБСЄ  (  994_055  )   поважати   незалежність   і

суверенітет та існуючі кордони України.

     2. Російська   Федерація,   Сполучене   Королівство   Великої

Британії  та  Північної  Ірландії  і   Сполучені   Штати   Америки

підтверджують їх зобов'язання утримуватися від загрози силою чи її

використання  проти  територіальної   цілісності   чи   політичної

незалежності  України,  і  що  ніяка  їхня  зброя  ніколи  не буде

використовуватися  проти  України,  крім  цілей  самооборони   або

будь-яким  іншим  чином  згідно зі Статутом Організації Об'єднаних

Націй ( 995_010 ).

     3. Російська   Федерація,   Сполучене   Королівство   Великої

Британії  та  Північної  Ірландії  і   Сполучені   Штати   Америки

підтверджують   Україні   їх   зобов'язання  згідно  з  принципами

Заключного акта  НБСЄ(  994_055  )  утримуватись  від економічного

тиску,  спрямованого на те,  щоб підкорити своїм власним інтересам

здійснення  Україною  прав,  притаманних її суверенітету,  і таким

чином отримати будь-які переваги.

     4. Російська   Федерація,   Сполучене   Королівство   Великої

Британії   та   Північної   Ірландії  і  Сполучені  Штати  Америки

підтверджують їх зобов'язання домагатися негайних дій з боку  Ради

Безпеки  Організації  Об'єднаних  Націй  з  метою надання допомоги

Україні як державі-учасниці Договору про нерозповсюдження  ядерної

зброї ( 995_098 ),  що не володіє ядерною  зброєю,  в  разі,  якщо

Україна стане жертвою акту агресії або об'єктом погрози агресією з

використанням ядерної зброї.

     5. Російська   Федерація,   Сполучене   Королівство   Великої

Британії   та   Північної   Ірландії  і  Сполучені  Штати  Америки

підтверджують щодо України їх зобов'язання не застосовувати ядерну

зброю проти     будь-якої     держави-учасниці     Договору    про

нерозповсюдження ядерної зброї ( 995_098 ),  що не володіє ядерною

зброєю,  крім випадку нападу на них самих,  їхні території чи їхні

підопічні  території,  їхні  збройні сили або на їхніх союзників з

боку такої держави спільно або в союзі  з  державою,  яка  володіє

ядерною зброєю.

     6. Україна,   Російська   Федерація,   Сполучене  Королівство

Великої Британії та Північної Ірландії і Сполучені  Штати  Америки

будуть  проводити  консультації  у  випадку  виникнення  ситуації,

внаслідок якої постає питання стосовно цих зобов'язань.

     Цей меморандум набуває чинності з моменту підписання.

     Підписано у   чотирьох    рівно    автентичних    примірниках

українською, англійською та російською мовами.

Ukraine, the Russian Federation, the United Kingdom of Great Britain and Northern Ireland, and the United States of America,

Welcoming the Accession of Ukraine to the Treaty on the Non-Proliferation of Nuclear Weapons as a non-nuclear-weapon state,

Taking into account the commitment of Ukraine to eliminate all nuclear weapons from its territory within a specified period of time,

Noting the changes in the world-wide security situation, including the end of the Cold War, which have brought about conditions for deep reductions in nuclear forces,

Confirm the following:

The Russian Federation, the United Kingdom of Great Britain and Northern Ireland, and The United States of America reaffirm their commitment to Ukraine, in accordance with the principles of the CSCE Final Act, to respect the independence and sovereignty and the existing borders of Ukraine.

The Russian Federation, the United Kingdom of Great Britain and Northern Ireland, and The United States of America reaffirm their obligation to refrain from the threat or use of force against the territorial integrity or political independence of Ukraine, and that none of their weapons will ever be used against Ukraine except in self-defense or otherwise in accordance with the Charter of the United Nations.

The Russian Federation, the United Kingdom of Great Britain and Northern Ireland, and The United States of America reaffirm their commitment to Ukraine, in accordance with the Principles of the CSCE Final Act, to refrain from economic coercion designed to subordinate to their own interest the exercise by Ukraine of the rights inherent in its sovereignty and thus to secure advantages of any kind.

The Russian Federation, the United Kingdom of Great Britain and Northern Ireland, and The United States of America reaffirm their commitment to seek immediate United Nations Security Council action to provide assistance to Ukraine, as a non-nuclear-weapon state party to the Treaty on the Non-Proliferation of Nuclear Weapons, if Ukraine should become a victim of an act of aggression or an object of a threat of aggression in which nuclear weapons are used.

The Russian Federation, the United Kingdom of Great Britain and Northern Ireland, and The United States of America reaffirm, in the case of Ukraine, their commitment not to use nuclear weapons against any non-nuclear-weapon state party to the Treaty on the Non-Proliferation of Nuclear Weapons, except in the case of an attack on themselves, their territories or dependent territories, their armed forces, or their allies, by such a state in association or alliance with a nuclear weapon state.

Ukraine, The Russian Federation, the United Kingdom of Great Britain and Northern Ireland, and The United States of America will consult in the event a situation arises which raises a question concerning these commitments.

This Memorandum will become applicable upon signature.

Signed in four copies having equal validity in the Ukrainian, English, and Russian languages.

Gran Bretagna e Irlanda del Nord e Stati Uniti,

     accogliendo favorevolmente l'adesione dell'Ucraina al Trattato di non proliferazione

armi nucleari come Stato non dotato di armi nucleari

Armi,

     tenendo conto dell'impegno dell'Ucraina di eliminare tutte le armi nucleari

armi situate sul suo territorio durante un certo periodo di tempo,

     Prendendo atto della mutevole situazione della sicurezza in tutto il mondo,compresa la fine della Guerra Fredda, che ha creato le condizioni per

profonde riduzioni delle forze nucleari,

     confermare quanto segue:

1. Federazione Russa, Regno Unito di Gran Bretagna e Irlanda del Nord e Stati Uniti riaffermano il loro impegno nei confronti dell'Ucraina conformemente ai principi L'Atto Finale della CSCE rispetta l'indipendenza e sovranità e confini esistenti dell'Ucraina.

2.La Federazione Russa, il Regno Unito di Gran Bretagna e Irlanda del Nord e gli Stati Uniti d'America riaffermano il loro obbligo di astenersi dalla minaccia o dall'uso della forza contro l'integrità territoriale o l'indipendenza politica dell'Ucraina e che nessuna delle loro armi potrà mai essere utilizzato contro l'Ucraina tranne che per autodifesa o altrimenti in conformità con la Carta delle Nazioni Unite.

3.La Federazione Russa, il Regno Unito di Gran Bretagna e Irlanda del Nord e gli Stati Uniti d'America riaffermano il loro impegno nei confronti dell'Ucraina, in conformità con i Principi dell'Atto Finale della CSCE, ad astenersi da coercizioni economiche volte a subordinare ai propri interessi la esercitare da parte dell'Ucraina i diritti inerenti alla sua sovranità e quindi ottenere vantaggi di qualsiasi tipo.

 

 

4. La Federazione Russa, il Regno Unito di Gran Bretagna e Irlanda del Nord e gli Stati Uniti d'America riaffermano il loro impegno a sollecitare un'azione immediata del Consiglio di sicurezza delle Nazioni Unite per fornire assistenza all'Ucraina, quale Stato non dotato di armi nucleari parte del Trattato sulla la non proliferazione delle armi nucleari, se l'Ucraina dovesse diventare vittima di un atto di aggressione o oggetto di una minaccia di aggressione in cui vengono utilizzate armi nucleari.

5. La Federazione Russa, il Regno Unito di Gran Bretagna e Irlanda del Nord e gli Stati Uniti d'America ribadiscono, nel caso dell'Ucraina, il loro impegno a non utilizzare armi nucleari contro qualsiasi Stato non dotato di armi nucleari parte del Trattato di non -Proliferazione delle armi nucleari, tranne nel caso di un attacco contro se stessi, i loro territori o territori dipendenti, le loro forze armate o i loro alleati, da parte di un tale stato in associazione o alleanza con uno stato dotato di armi nucleari.

6. L'Ucraina, la Federazione Russa, il Regno Unito di Gran Bretagna e Irlanda del Nord e gli Stati Uniti d'America si consulteranno nel caso in cui si presenti una situazione che sollevi una questione su questi impegni.

Il Memorandum diventerà applicabile al momento della firma.

Firmato in quattro copie aventi uguale validità nelle lingue ucraina, inglese e russa.
